1. Introduction
These Terms and Conditions govern the sale of goods by Fresh Horizons Group, Inc. ("we", "us", "our"), operating as an online and phone-order retailer within the United States. By placing an order with us, you agree to be bound by these Terms and Conditions.
2. Products and Pricing
All prices are listed in U.S. Dollars (USD). Prices, descriptions, and availability of products are subject to change without notice. We strive to ensure all product information is accurate; however, errors may occur, and we reserve the right to correct any inaccuracies at any time.
3. Orders and Payment
Orders are accepted once full payment has been received. Accepted payment methods include major credit and debit cards, PayPal, and other electronic payment systems as available at checkout. We reserve the right to refuse or cancel any order if fraud is suspected, payment authorization fails, or an error in pricing or availability is detected.
4. Delivery and Shipping
We aim to deliver all orders within the estimated timeframes provided at checkout. Delivery times may vary depending on location and carrier. Shipping fees will be clearly displayed before order confirmation. Risk of loss or damage to goods passes to the customer upon delivery.
5. Returns, Exchanges, and Refunds
5.1 Physical Goods (Apparel and Promotional Items) We accept returns or exchanges of eligible goods within 10 days of purchase. Items must be unused, unopened, and in their original packaging. Certain items, such as perishable goods, Personalized products, and gift cards, are non-returnable. Refunds will be processed using the original payment method within 7–10 business days after we receive and inspect the returned item.
5.2 Digital Goods and Services (Websites, CRM, Email Campaigns, Digital Ads, Logos, Design Work, Social Media Management, and all other non-physical products) Refunds/cancellations may be requested within 3 business days if a digital product or service has not already been delivered. If the digital product or service has already been delivered, no refunds will be given.
5.3 We do not offer refunds on consulting, training, or digital courses.
6. Warranties and Liability
Products may come with manufacturer warranties where applicable. To the maximum extent permitted by law, we disclaim all implied warranties. We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products. Nothing in these Terms affects your statutory rights.
7. Privacy and Data Protection
We respect your privacy and handle your personal data in accordance with our Privacy Policy. By placing an order, you consent to our collection and use of your information for processing and fulfilling your purchase. We comply with applicable data protection laws within the United States.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.
